Wayne:

That's kinda backwards!  Most regulators will not fully regulate until they
have some load on it.  That is, if the regulator is supposed to be a, say,
5.1v, it may be at 5.3 or 5.4v until it gets roughly a 100 ma load on it.
Then it will lock in at 5.1v.

I suggest that you need to send it back to the manufacturer for replacement!
